We do not knowingly collect any sensitive personal data or any data defined under special categories under Applicable Data Law (as defined below).

We may also use Personal Data for the following purposes:

  • to fulfill your requests for the Services, and/or to access and use the Services;
  • to provide personalized services, including without limitation, content and advertisements;

Types of Data & Purpose for Collection and Use

Account Registration

For users of the Services, we may collect your name, email, phone number, and other contact information when you create a user account.

Employment

If you apply for an employment opportunity or become an employee of Maison Foodie and/or its affiliated companies, we may collect personal information necessary to process your application and to process your employment with Maison Foodie and/or its affiliated companies. Such personal information may include, without limitation, your name, email address, phone number, home address/postal address, birthdate, and tax identification number.

Feedback & Support

If you provide us with feedback, require any technical support, or if you contact us or any of our affiliated companies for other assistance, we will collect your name and email address and possibly other personal information and/or any other content that you may send to us.

Financial Data

We will collect your credit card information to process your purchase of a Subscription License. We will also use your banking/financial information for employment and payroll purposes.

Mailing List/Newsletters

When you choose to sign up for one of our mailing lists or choose to subscribe to one of our online newsletters, we will collect your email address and/or postal address.

Marketing & Communications

We may collect information about (i) how you use the Services and/or any products and/or services associated with any of the foregoing; (ii) any testimonials that you may provide to us regarding your use of the Services; (iii) your preferences in receiving marketing and communications from us, our affiliated companies, and our third-party partners; and (iv) your communication preferences.

Mobile Devices

We may collect information from your mobile device, such as unique identifying information that may be broadcast from your mobile device, or hardware, software, and/or operating system specifications. We may also ask if you would like to share your location information from your mobile device.

Technical User Data

We may collect your Internet Protocol (IP) address, IP browser user agent and other Internet browser information, which may include without limitation, browser location data received from GPS coordinates in order to deliver relevant content and advertisements to you and to measure and understand the effectiveness of the content and advertising we serve and provide to you.

Third-Party Tracking

We participate in behavior-based advertising. This means that a third party may use certain technologies (such as a cookie, or other similar technologies) to collect information about your use of the Services in order to provide you with tailored advertising for other products and/or services that may suit your interests. Such advertising may appear either through the Services, or on other websites (which may include without limitation, social media platforms, social media services, online marketplace platforms, and/or other search engines).

If and when we use a third-party payment processing merchant, third-party technical support provider, third-party technology provider, or third-party hosting provider, we ensure that the same privacy criteria, as defined herein with respect to Personal Data, are in place with such third parties. We do not (knowingly) collect personal information from minors or children. “Minors” or “children” are individuals under the age of thirteen (13), or under such age as defined under Applicable Data Law or the country’s minimum age where the person resides.

“Anonymous Data” refers to data about you that is not associated with or linked to your Personal Data. Anonymous Data does not permit the identification of individual persons. If and when we use a third-party technical support provider or third-party hosting provider, we ensure that the same privacy criteria as defined herein with respect to Anonymous Data are in place with such merchant.

To make the Services more useful to you, our servers (which may be hosted by a third-party service provider) may collect Personal Data, Anonymous Data, or Application Data from you such as web browser type, operating system type and version, Internet Protocol (IP) address, geolocation data, domain name, Services version, Services usage and statistics, and/or a date/time stamp of your visit. We may use cookies and navigational data like Uniform Resource Locators (URL) and referring URLs to gather information regarding the date and time of your visit or the domain from which you download our mobile product(s) and/or related software. We may use Anonymous Data for market research purposes and to improve the Services and any other related products and/or services.

How We Collect and Use Application Data


“Application Data” refers to data about how you use the Services. The Services may collect certain information from you including, but not limited to user IP addresses, geolocation data, OS version, OS localization, version of any mobile applications, localization of the Services, device, bug reports, etc. The Services obtain this information as a result of data being sent to our servers from our software “agent” embedded in the mobile applications and related software, or on the website that you are accessing. The Services may collect certain Application Data from your computer(s) and/or mobile devices that may be deemed Personal Data under Applicable Data Law. Application Data we collect is primarily used to report application usage and statistics, improve the Services, and to track the performance of various marketing initiatives. Application Data may also be used by us to answer questions that you may have about your use of the Services, and any associated product(s) and/or service(s). We will only use Personal Data in accordance with this Privacy Policy. We will not use any Application Data that may be deemed as Personal Data for any other purposes unless you authorize such use with your affirmative consent.

We offer you choices regarding the collection, use, and sharing of your Personal Data. If you opt in to receive our newsletters, we may periodically send you such newsletters and emails that directly promote the use of the Services, and/or other products, goods, services, software applications, and/or software extensions that may be of interest to you. When you receive newsletters or promotional communications from us, you may indicate a preference to stop receiving further communications from us and you will have the opportunity to “opt-out” by following the unsubscribe instructions provided in the email you receive, or by contacting us directly (please see contact information below). Should you decide to opt-out of receiving future mailings from us, you may continue to receive future mailings from third parties that you have requested to receive information from. We may also share Personal Data with our affiliated companies for customer support, marketing, and technical operations purposes.

Your Rights With Respect to Your Personal Data

“State Data Protection Laws” means, without limitation, (1) the California Consumer Privacy Act (CCPA) of 2018, as amended, including as amended by the California Privacy Rights Act of 2020 (CPRA), and any regulations promulgated thereunder; (2) the Colorado Privacy Act (CPA); (3) the Connecticut Data Privacy Act (CTDPA); (4) the Delaware Personal Data Privacy Act (DPDPA); (5) the Iowa Consumer Data Protection Act (ICDPA); (6) the Maryland Online Data Privacy Act (MODPA); (7) the Minnesota Consumer Data Privacy Act (MCDPA); (8) the Montana Consumer Data Privacy Act (MTCDPA); (9) the Nebraska Data Privacy Act (NDPA); (10) the New Hampshire Privacy Act (NHPA); (11) the New Jersey Data Privacy Law (NJDPL); (12) the Oregon Consumer Privacy Act (OCPA); (13) the Tennessee Information Protection Act (TIPA); (14) the Texas Data Privacy and Security Act (TDPSA); (15) the Utah Consumer Privacy Act of 2022 (UCPA); and (16) the Virginia Consumer Data Protection Act (VCDPA), in each case as amended and including any regulations promulgated thereunder, and other US state privacy laws similar in scope to the foregoing that contemplate similar consumer rights, each as and when they become applicable, as amended, superseded, and including any rules and implementing regulations promulgated thereunder. The foregoing excludes privacy laws enacted by any state that are materially different in form or scope, such as laws exclusively governing consumer health data or pertaining to the protection of minors online.

“Swiss FADP” means the Swiss Federal Act on Data Protection.

“UK Data Law” means the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

In accordance with Applicable Data Law, you may have the following rights in respect of your personal information that we collect and hold:

  • Right of access and portability. The right to obtain access to and to receive your Personal Data.
  • Right to rectification/correction. The right to obtain rectification of your Personal Data without undue delay where that personal information is incorrect, inaccurate or incomplete.

Please note that by choosing to opt-out of tailored advertising, you are opting out of the behavioral targeting.
